Rajasthan: A doctor in the state of Rajasthan has wrongly treated a man for three years for HIV. The Rajasthan State Consumer Dispute Redressal Commission made the doctor who gave wrong treatment pay compensation to the man.the doctor wrongly treated the man for HIV before confirming if he actually had the disease.
The medical insurance company, as well as the doctor who administered incorrect treatment to the man, were made to pay a compensation. The compensation they have been asked to pay is for the medical negligence to give wrong treatment to the man for HIV.
Man Wrongly Treated for HIV Doctor asked to pay Compensation:
The man was called Dhanraj Patel who went to the M B Government Hospital back in the year 2004. At that time the man was suffering from fever, cold and cough. An associate professor of medicines, Dr. D C Kumawat suspected that the man is suffering from HIV and thought him to be HIV patient. He started off the HIV treatment to the man without confirming the HIV disease with the required tests. While the treatment was in process the man called Dhanraj Patel visited another hospital in Mumbai city. There he tested negative for HIV. He even brought the negative HIV report to this doctor. However, the doctor went ahead and advised continued treatment for treating the HIV disease. This treatment went on for a period of seven complete years. Due to this, the patient Dhanraj Patel’s death went down. This was because of side effects of the HIV Treatment. Moreover, the medical insurance company also rejected his claims.
Finally in the year 2013, the patient complainant approached the commission. Then the commission found that the doctor was guilty of medical negligence. Last month the commission after finding the doctor guilty of medical negligence, passed the order. The commission directed the doctor as well as the National Insurance Company to pay a compensation. The medical insurance company and the doctor were ordered to jointly pay a sum of Rs. five lakh towards compensation to the complainant. The complainant was the man who was wrongly treated for HIV disease for seven years.
